Terms of Service

These Terms of Use (“Terms”) govern your access to and use of Roots We Planted (the “Service”), operated by Roots We Planted. By creating an account, accepting these Terms in the app, or otherwise using the Service, you agree to be bound by them. If you do not agree, do not use the Service. If you use the Service on behalf of others (e.g. family members), you confirm you have authority to do so.

1. Eligibility & your account

You must be at least 18 years old (or the age of majority where you live) to create an account. You are responsible for the security of your account and for all activity under it. Don't share your login; notify us immediately at support@rootsweplanted.com if you suspect unauthorized access.

2. Your content & the rights you grant us

You retain full ownership of every photo, recording, document, story, and family detail you upload (“Your Content”). You grant us a limited licence to store, process, and transform Your Content solely to operate the Service and produce the deliverables you request. We do not sell Your Content, use it for advertising, or use it to train AI models without your explicit consent. You are responsible for ensuring you have the right to upload Your Content and to depict the people it concerns.

3. AI-generated content & accuracy

The Service uses artificial intelligence to generate transcriptions, research summaries, biographies, narratives, restored and animated portraits, and audio narration. These outputs are drafts that may contain errors or inferred material; they are not professional genealogical, legal, or historical advice, and you should verify facts before relying on them. We apply a “fiction firewall” so generated stories do not assert undocumented facts — see our accuracy protocol. Subject to the rights of third parties, outputs we generate for you are yours to use.

4. Consent & voice cloning

Some features create a synthetic voice or animated likeness of a person. You may only use these features where you have the necessary consent: for living people, their explicit consent; for deceased people, the authority of the family/estate as permitted by law. You must not use the Service to impersonate anyone, to create misleading “deepfakes,” or to depict any person — living or dead — in a harmful, defamatory, or deceptive way. We may require proof of consent and may decline or remove content that violates this section.

5. Acceptable use

You agree not to: upload content you have no right to share; infringe others' intellectual property or privacy; upload unlawful, harmful, or harassing material; attempt to breach security or access other users' data; or use the Service to build a competing dataset or model. We may suspend or terminate accounts that violate these Terms.

6. Payment, plans & refunds

Paid plans, credits, and physical deliverables (such as printed books) are billed as described at checkout; payments are processed by Stripe. Each tier may include a defined number of revision rounds. Refund eligibility varies by tier and project phase — contact customer success for specifics. Printed/physical orders already in production may be non-refundable.

7. Third-party services

The Service relies on third-party processors (for example storage, payments, and AI providers) described in our Privacy Policy. Your use of the Service is also subject to those providers' terms where applicable.

8. Disclaimers & limitation of liability

The Service is provided “as is” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that AI outputs are accurate or complete. To the maximum extent permitted by law, Roots We Planted is not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

9. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access for breach of these Terms. On deletion, your data is handled as described in the Privacy Policy.

10. Changes to these Terms

We may update these Terms. When changes are material we will update the version date above and ask you to re-accept the Terms the next time you use the Service. Continued use after changes take effect means you accept the updated Terms.
